CEO hearing postponed

The disciplinary hearing of suspended uMhlathuze Municipal Manager, Dr Tonie Heyneke, has been postponed without any arguments on the merits of the main charges. Heyneke’s attorney, Philip Walsh, argued that council did not have the authority to prosecute and that it should have been a decision of the Executive Committee. He also argued that the resolution sanctioning the prosecution was defective. Prosecutor and Council representative, Mr Buthelezi, requested time to prepare a written address on the points raised. The presiding officer is expected to make a decision on the validity of the disciplinary proceedings on Tuesday after hearing from both parties. Acting Municipal Manager, Nkosinathi Nhleko, was unavailable for comment. Meanwhile, the pending labour court case has been postponed until 11 March.
